Please read these terms carefully before using the Hamlah platform. Your use of the platform constitutes acceptance of these terms and conditions.

1. Acceptance of Terms

By using the Hamlah platform (the "Platform") operated by Hamlah ("Company", "we", "us", or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to any of these Terms, please stop using the Platform immediately. If you are using the Platform on behalf of a business entity, you represent that you are authorized to accept these Terms on behalf of that entity.

2. Service Description

Hamlah is an integrated platform for managing Hajj, Umrah, and tourism trips, enabling travel companies and offices to create trips, manage reservations, track payments, organize housing and vehicles, and generate financial and operational reports. We reserve the right to modify, update, or discontinue the Service partially or fully at any time with appropriate advance notice.

3. Account Registration & Eligibility

To use the Platform, you must:

  • Be at least 18 years old, or represent a licensed business entity.
  • Provide accurate, truthful, and complete information during registration and keep it updated.
  • Keep your login credentials confidential and not share them with unauthorized parties.
  • Accept full responsibility for all activity occurring under your account.

4. Acceptable Use

You agree to use the Platform only for lawful purposes. You specifically agree not to:

  • Violate any applicable laws or regulations in Saudi Arabia or any relevant jurisdiction.
  • Enter false, misleading, or unlawful data into the Platform.
  • Reverse engineer or attempt unauthorized access to any part of the Platform or its infrastructure.
  • Resell or transfer Platform access to third parties without prior written consent.
  • Take any action that harms Platform performance, security, or interferes with other users' use.
  • Upload or transmit any content containing malware, viruses, or harmful code.

5. Subscriptions & Payments

The Platform is offered under defined subscription plans. By subscribing to a paid plan, you agree to the following:

  • Pay the specified subscription fees on time and in the agreed currency.
  • All subscription fees are non-refundable except as provided by the applicable refund policy.
  • We reserve the right to adjust subscription pricing with at least 30 days' advance notice.
  • If payment fails or is declined, your account may be suspended until outstanding payments are settled.

6. Intellectual Property

All intellectual property rights related to the Platform — including software, design, trademarks, and content — are the exclusive property of Hamlah or its licensors and are protected by applicable intellectual property laws. Under these Terms, the Company grants you a limited, non-exclusive, non-transferable license to use the Platform in accordance with these Terms. Nothing in these Terms shall be construed as transferring any intellectual property rights to you.

7. Disclaimer & Limitation of Liability

The Platform is provided "as is" and "as available" without any express or implied warranties. The Company does not guarantee that the Platform will be error-free or continuously available without interruption.

The Company shall not be liable to you under any circumstances for indirect, incidental, special, or consequential damages arising from your use of or inability to use the Platform, even if advised of the possibility of such damages. The Company's maximum civil liability to you in any event shall be limited to the fees you paid to the Company during the three months preceding the incident.

8. Suspension & Termination

You may terminate your account at any time through the Settings or by contacting the support team. The Company may suspend or terminate your account immediately upon violation of these Terms or upon reasonable suspicion of fraudulent activity. Upon termination, your right to access the Platform ceases and your data will be deleted in accordance with the applicable Privacy Policy.

9. Governing Law & Dispute Resolution

These Terms are governed by the applicable laws and regulations of the Kingdom of Saudi Arabia. Any dispute arising from or related to these Terms shall first be subject to good-faith efforts to reach an amicable settlement. If unsuccessful, the dispute shall be referred to the competent judicial or arbitration authorities in the Kingdom of Saudi Arabia.

10. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will notify you via your registered email or a prominent notice within the Platform at least 14 days before the changes take effect. Your continued use of the Platform after changes take effect constitutes your acceptance of those changes.
